Warranty Disclosure Framework

Warranty Identity

  • Warrantor: [VERIFY: LEGAL NAME AND ADDRESS].
  • Covered product/SKUs: [VERIFY].
  • Classification: [COUNSEL VERIFY: FULL OR LIMITED, IF MAGNUSON-MOSS APPLIES].
  • Coverage period and start date: [VERIFY].
  • Transferability: [VERIFY].

Coverage and Exclusive Remedy

State in plain language which parts, labor, diagnostics, fluids, towing, shipping and incidental costs are covered. Identify the remedy—repair, replacement, refund or warrantor’s choice—and any reasonable number-of-attempts process. Do not describe an exclusion or remedy more broadly in marketing than in the written warranty.

Customer Responsibilities

State every material installation, activation, break-in, maintenance, documentation, preauthorization and supporting-system requirement before purchase. A requirement must be reasonably related to the product and administered consistently. Do not imply that the customer must purchase branded parts or service unless legally permitted and accurately stated.

Exclusions

List verified exclusions, such as misuse, overheating, oil starvation, improper installation, unauthorized modification or failure to follow documented requirements. Exclusions must not be used to deny a claim without a reasonable factual basis connecting the excluded condition to the failure where applicable law requires that connection.

How to Obtain Service

  1. Stop operation when continued use could cause additional damage.
  2. Contact [VERIFY: WARRANTY ADMINISTRATOR] at [VERIFY] before teardown or repair when preauthorization is required.
  3. Provide the order number, SKU/serial number, installation records, maintenance records, diagnostic information and requested photographs.
  4. Follow reasonable inspection, return and claim instructions.
  5. Receive a written coverage determination and approved remedy.

State-Law Savings Notice

Some states do not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, so particular limitations may not apply. The customer may have specific legal rights and may also have other rights that vary from state to state. Counsel must tailor this notice to the actual written warranty and sales footprint.
